GENERAL TERMS AND CONDITIONS

1. Definitions 

  • “CQCS / Laboratory” means CQCS Laboratory India LLP, a testing, inspection, and analytical service provider.
  • “Client” means any individual, firm, company, government body, or organization requesting Services from CQCS.
  • “Services” include inspection, sampling, testing, analysis, evaluation, reporting, certification support, and related technical services.
  • “Report / Test Report / Inspection Certificate” means the official document issued by CQCS.

 2. Scope of Services 

  • CQCS shall perform Services strictly in accordance with:
  • Client’s written request, quotation, or work order as agreed and understood while assigning for Job
  • Applicable Indian or international standards (IS, ISO, AOAC, BIS, ASTM, FSSAI, etc.) or
  • CQCS’s approved methods and procedures

 3. Acceptance of Work 

  • Work shall be considered accepted upon Written or email confirmation by CQCS, or Receipt of samples, inspection request, or advance payment (if applicable)
  • CQCS reserves the right to refuse, suspend, or withdraw Services if, Samples are unsafe, insufficient, contaminated, or improperly packed. Required technical or statutory information is incomplete
  • Payment terms are not complied with

 4. Sampling 

  • Unless explicitly agreed in writing, sampling is not included in the quoted scope. Where CQCS performs sampling, it shall be carried out as per:
  • Applicable standards, guidelines, or client-approved procedures. Test results apply only to the sample(s) tested and do not represent the entire lot, batch, or consignment unless clearly stated.

 5. Samples Handling and Storage 

  • The Client is responsible for proper identification, labelling, packaging, and transportation of samples. CQCS shall not be liable for sample deterioration due to Perishable nature or inherent characteristics
  • Testing beyond recommended holding time
  • Unless otherwise agreed, tested samples shall be retained for 15 days from the date of report issuance and then safely disposed of.

 6. Test Reports and Certificates 

  • All reports and certificates are issued in writing (physical or digital) and remain the property of CQCS. Reports shall not be Partially reproduced. Altered or used for advertising, legal, or promotional purposes without prior written approval from CQCS. Test results relate only to the parameters tested and shall not be considered as product approval or certification.

 7. Confidentiality 

  • CQCS shall maintain confidentiality of all Client information, samples, and results. Disclosure may occur only when:
  • Required by law, court order, or regulatory authority. Authorized in writing by the Client

 8. Client Responsibilities 

  • The Client shall. Provide complete, accurate, and truthful information. Declare any hazardous, toxic, or bio-risk materials
  • Ensure compliance with applicable laws. Use reports strictly for their intended purpose
  • Make timely payments as agreed

 9. Fees, Taxes & Payment 

  • Fees shall be as per the accepted quotation, rate contract, or work order. GST and other statutory taxes shall be charged extra as applicable. Payment shall be made immediate against/ from invoice date unless otherwise agreed. CQCS reserves the right to Withhold reports. Suspend ongoing work in case of non-payments.

 10. Liability & Limitation 

  • CQCS’s total liability shall be limited to the amount of fees paid for the specific Service. CQCS shall not be liable for:
  • Indirect, incidental, or consequential losses. Business loss, recalls, penalties, or loss of market. Decisions taken by the Client based on the report

 11. Indemnity 

  • The Client shall indemnify and hold harmless CQCS against all claims, damages, or losses arising from Misuse or misinterpretation of reports. Inaccurate or incomplete information provided by the Client. Unauthorized reproduction or

         use of reports 12. Complaints & Appeals 

  • Complaints or appeals shall be submitted in writing within 7 days of report issuance. CQCS shall investigate complaints as per its documented quality procedures.

 13. Force Majeure 

  • CQCS shall not be responsible for delay or failure due to events beyond its control, including natural disasters, strikes, power failure, government restrictions, or unforeseen technical breakdowns.

 14. Suspension or Termination 

  • CQCS may suspend or terminate Services without liability if. Payment obligations are not met. These Terms & Conditions are breached. Continued work compromises impartiality, safety, or regulatory compliance

 15. Governing Law & Jurisdiction 

  • These Terms & Conditions shall be governed by the laws of India, and courts at Bhavnagar, Gujarat shall have exclusive jurisdiction.

 16. Acceptance Submission of samples, inspection requests, or work orders shall constitute full acceptance of these Terms & Conditions by the Client.
